Terms of Service

Return to the Carnelian Sanchez, LLC homepage ->

These Terms of Service set out the agreement between you and Carnelian Sanchez, LLC for the use of our website and for the tumbling, polishing, cutting, sorting, restoration and mount preparation work carried out at our shop. Please read them carefully. By using our website or by sending a load of stone to the bench, you agree to be bound by the terms described here.

Acceptance of Terms

By visiting our website, by sending a message through the contact form or by delivering rough stone to our shop, you accept these Terms of Service in full. If you do not accept them, please do not use the site and please contact us before sending any work so that another arrangement can be discussed.

You also accept our Privacy Policy, which explains how information is handled. The two documents should be read together. Where a question about data is not covered here, the Privacy Policy governs the matter.

These terms apply to every visitor, customer and representative of a club or institution, whether the contact is made online, by telephone or in person at the West Valley City bench. No variation of these terms is effective unless we agree to it in writing.

Who We Are

Carnelian Sanchez, LLC is an agate tumbler and lapidary workshop operating from 4995 W Sandwell Dr, West Valley City - 84120-6473, United States (US). The contact email address is support@carneliansanchez.autos and the contact telephone number is +18655005937. The developer of this website is Carnelian Sanchez.

Where these terms refer to we, us or our, the reference is to Carnelian Sanchez, LLC. Where they refer to you, the reference is to the visitor, the customer or the person acting for a club or institution that deals with our shop.

Our shop is a working bench rather than a retail counter. The services we provide are described on the services page, and the specific work for a particular load is agreed at the time the load is accepted.

Eligibility

You may use our website and our services if you are able to form a binding contract. A young person who wishes to send work must do so through a parent, a guardian or a responsible adult, who is then treated as the customer for the purposes of these terms.

If you act for a club, a school or another institution, you confirm that you are authorised to accept these terms on its behalf. The institution is then responsible for the load and for any fee connected to it.

We reserve the right to decline work or to withdraw access to the website where we have a good reason, such as a risk to safety, a breach of these terms or a matter we cannot lawfully accept.

Scope of Services

The services offered by Carnelian Sanchez, LLC include stone tumbling, surface polishing, cutting and shaping, rough stock selection, collection restoration and display mount preparation. Each service is performed at our shop and each is described in more detail on the services page of this website.

The scope of a job is the scope agreed at intake. If you later ask for extra work, such as an additional cleaning stage or a change to the finish, that becomes a new instruction and may affect the schedule and the fee. We will confirm any change before we carry it out.

We do not offer gemstone certification, formal appraisal or an opinion on the market value of a stone. Where a customer asks for such an opinion, we will say clearly that it is outside the scope of the shop.

Quotes and Estimates

A quote is prepared on the basis of the information available at the time, which may be a description, a photograph or an inspection of the load itself. An estimate is a good faith figure and not a fixed price unless we say so in writing.

Rough stone can conceal a fracture or a soft zone that only becomes clear once the surface is opened. If the work reveals something that changes the time or the material required, we will tell you before we continue and we will seek your instruction.

A quote remains open for the period stated within it and lapses after that time. Where no period is stated, the quote is valid for thirty days, after which a fresh figure may be prepared.

Acceptance of Loads

A load is accepted when we confirm it, either in writing or by taking the stone into the shop record. Until that point, no obligation arises on our side. We may decline a load that is unsafe, that is not suitable for the drum or that raises a question we cannot resolve.

At intake we weigh the load, describe it and note the condition of the stone. That record is the basis for the job. Where a customer disagrees with the record, the point should be raised at intake rather than after the drums have turned.

Please do not include items you do not wish to be tumbled together with the main load. If a batch contains a piece that should be treated separately, mark it clearly and tell us at intake so that it can be handled on its own.

Stone Risk and Inherent Loss

Tumbling and polishing necessarily remove material. A stone becomes smaller as a load progresses, and an edge or a thin section may be lost along the way. This is not a fault in the work. It is the nature of the process, and by sending a load you accept it.

Some stone carries a hidden fracture that will open under the drum. We take care to inspect a load and to warn you where we see a risk, but we cannot guarantee that a piece will survive. Where a fragile piece is important to you, tell us and we will discuss a gentler treatment or a hand only approach.

Every load carries a weight of risk simply because it is stone in a turning barrel. Our promise is skill and care, not an outcome that no workshop could guarantee. We will always be honest with you about what happened to a load and why.

Turnaround and Scheduling

A full tumble runs through several grit stages and each stage needs its own time. A job is therefore measured in weeks rather than days. We will give you an expected window at intake, and we will tell you if a stage runs longer than planned.

Loads are started at the beginning of a working week, and a busy batch window may push a start date back. We schedule to protect the quality of the finish, not to hit an arbitrary date, because rushing a stage is how fractures appear.

If you have a deadline, tell us at intake. We may be able to arrange a schedule that suits it, or we may advise plainly that the drum cannot meet the date without risking the load.

Fees and Payment

Fees are based on the nature and the volume of the work, and they are confirmed before a load is started. Where a job is unusually large or unusually delicate, a higher figure may apply, and we will explain the reason before you commit.

Payment is due on the terms stated in the quote, which may be a deposit before the drums turn and the balance before collection. We accept the payment methods listed on the quote. Please do not send payment details through the website form.

Where a load is abandoned after the work has begun and the customer does not collect it or pay for it, we may charge for the time and material already spent. We will always try to resolve such a matter by contacting you first.

Collection and Storage

A finished load is held at the shop until it is collected or shipped. We will notify you when the work is ready. Please collect within a reasonable period, as bench space is limited and a finished load takes up room that a new job needs.

Where a load is not collected within the period stated in the notice, we may apply a modest storage charge. Where a load remains uncollected for a long period after repeated reminders, we may treat it as abandoned and dispose of it in a lawful manner.

If you ask us to ship a load, packaging, carriage and insurance are arranged at your cost and on terms agreed in advance. Risk in transit passes to you once the carrier takes the load from the shop.

Ownership and Title

You confirm that you own the stone you send or that you are authorised to have it worked. You must not send material that belongs to another person without that person permission, and you must not send material that was obtained unlawfully.

Title in the stone remains with you throughout the work. Title in the finished piece remains with you once any outstanding fee is paid. We claim no ownership of your material at any point.

Until all fees for a job are paid, we may hold the finished work and the records connected to it. This right to hold is exercised only where a fee is genuinely outstanding and after we have made reasonable attempts to resolve the matter.

Acceptable Use of the Website

You agree to use the website in a lawful and considerate manner. You must not attempt to disrupt the site, to gain access to an area you are not authorised to use, or to send a message that is abusive, threatening, misleading or unlawful.

You must not use the contact form to send unsolicited advertising, a bulk message or a file that carries a harmful program. The form exists so that a customer can reach the bench, and it should be used for that purpose.

We may suspend access to the website where a breach of this section occurs. Where the breach is serious or repeated, we may also decline future work and, if necessary, take further steps to protect the shop and its customers.

Intellectual Property

The text, layout, graphics and code of this website belong to Carnelian Sanchez, LLC unless otherwise noted. They are protected by the ordinary rules of copyright and may not be copied for a commercial purpose without written permission.

You may read the pages, print a copy for your own reference and link to the site in an honest way. You may not reproduce the content wholesale, present it as your own or use it to build a competing site.

Photographs of a finished load remain the property of the shop where we made them, and they may be shown as an example of the work. Where a customer asks us not to show a piece, we will respect that request. Names and contact details are not published without consent.

Disclaimer of Warranties

The website and its content are provided as they are. We keep the pages accurate and available, but we do not promise that the site will be free of interruption, that every detail will be current at every moment or that it will meet a particular expectation.

We do not warrant a specific result for a load of stone, because the outcome depends on the material as much as on the work. What we warrant is that the services will be carried out with the skill and the care that a competent lapidary shop would apply.

To the fullest extent the law allows, we disclaim all other warranties, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Nothing in these terms removes a right that the law does not allow to be removed.

Limitation of Liability

To the fullest extent the law allows, Carnelian Sanchez, LLC is not liable for indirect, incidental or consequential loss arising from the use of the website or from a job carried out at the shop. This includes loss of profit, loss of an opportunity and loss arising from a stone that tumbled smaller than expected.

Where liability cannot be excluded, our total liability for a claim connected to a job is limited to the fee paid for that job, except where the law sets a different figure or where the loss results from our gross negligence or wilful misconduct.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud or for any other matter that the law does not permit to be limited. Where a limit is not enforceable, the remaining terms continue to apply in full.

Indemnity

You agree to indemnify Carnelian Sanchez, LLC against a claim, a loss or a cost that arises from your breach of these terms, from material you send that you did not have the right to send, or from a message that is unlawful or misleading.

This indemnity covers the reasonable cost of responding to a claim, including legal advice where it is genuinely needed. It does not apply where the loss was caused by our own fault, and it is limited to what is reasonable in the circumstances.

We will notify you promptly if a claim covered by this section is made, and we will take reasonable steps to reduce the loss. You may participate in the defence of such a claim through your own adviser where that is appropriate.

Suspension and Termination

We may suspend or end your access to the website or to our services where you breach these terms, where we cannot lawfully continue or where a matter cannot be resolved to the satisfaction of both sides.

Where a job is already in progress when a suspension is considered, we will discuss the position with you first and try to find a way to finish the load fairly. A load that is already in the drum will be completed where it is safe to do so.

Where the agreement ends, the sections of these terms that by their nature should survive will continue to apply. These include the sections on intellectual property, warranties, liability and governing law.

Governing Law and Disputes

These terms are governed by the laws of the State of Utah and by the applicable laws of the United States. Any dispute that cannot be settled by discussion will be dealt with in the courts that have jurisdiction over the place where the shop is located.

Before going to court, we ask that you contact us directly and give us a reasonable chance to resolve the matter. Most concerns about a load can be settled with a clear conversation and, where appropriate, a further pass at the bench.

If a part of these terms is found to be unenforceable, that part will be treated as removed and the rest of the document will continue in force. The removal of one part does not affect the validity of the others.

Changes to These Terms

We may update these terms from time to time so that they continue to describe the way the shop works. When a change is made, we will revise the date shown at the foot of the page, and where the change is significant we will describe it in a clear notice on the site.

Your continued use of the site or your continuation of a job after a change means that you accept the updated terms. If you do not accept a change, you are welcome to contact the shop to discuss it before you decide how to proceed.

We keep earlier versions on file so that the history of the document can be traced if a question arises. A request to see an earlier version will be met where it is reasonable to do so.

Contact Information

If you have a question about these terms, a request about a job or a concern about the way the shop has handled a matter, please contact us directly. The fastest routes are email and telephone, and a real person at the bench will read what you send.
